  Bicycles are Vehicles

  • 316.2065(1)    Every person propelling a vehicle by human power (on a roadway) has all the rights and all of the duties applicable to the driver of any other vehicle.
  • 316.2065 (3)(d)    A bicycle rider or passenger who is under 16 years of age MUST wear a bicycle helmet that is properly fitted and is fastened securely upon the passenger's head by a strap.
  • 316.2065(5)(a)    Any person operating a bicycle upon a roadway at less than the normal speed of traffic at the time and place and under the conditions then existing shall ride as close as practicable to the right-hand curb or edge of the roadway except under any of the following situations:
    • When overtaking and passing another bicycle or vehicle proceeding in the same direction.
    • When preparing for a left turn at an intersection or into a private road or driveway.
    • When reasonable necessary to avoid any condition, including, but not limited to, a fixed or moving object, parked or moving vehicle, bicycle, pedestrian, animal, surface hazard, or substandard-width lane, that makes it unsafe to continue along the right-hand curb or edge.  For the purposes of this subsection, a "substandard-width lane" is a lane that is too narrow for a bicycle and another vehicle to travel safely side by side within the lane.
  • 316.2065(5)(b)    Any person operating a bicycle upon a one-way roadway with two or more marked traffic lanes may ride as near the left-hand curb or edge of such roadway as practicable.
  • 316.2065(6)    Persons riding bicycles upon a roadway may not ride more than two abreast except on paths set aside for the exclusive use of bicycles.  Persons riding two abreast may not impede traffic when traveling at less than the normal speed of traffic at the time and place and under the conditions then existing and shall ride within a single lane.
  • 316.2065(7)    Any person operating a bicycle shall keep at least one hand upon the handlebars.
  • 316.2065(8)    Every bicycle in use between sunset and sunrise shall be equipped with a lamp on the front exhibiting a white light visible from a distance of at least 500 ft. to the front and a lamp and reflector on the rear each exhibiting a red light visible from a distance of 600 ft. to the rear.
  • 316.2065(14)    Every bicycle shall be equipped with a brake or brakes which will enable its rider to stop the bicycle within 25 ft. from a speed of 10 mph on dry, level, clean pavement.
  • 316.304(1)    No person shall operate a vehicle while wearing a headset or other listening device, other than a hearing aid.
  • 316.151(1)    A bicyclist intending to make a left turn is entitled to full use of the lane from which the turn is made.
  • 316.155(2)    A signal of intention to turn must be given during the last 100 ft. traveled by the bicycle before turning.
  • 316.2065(10)    A person propelling a vehicle by human power upon and along a sidewalk, or across a roadway upon and along a crosswalk, has all the rights and duties applicable to a pedestrian under the same circumstances.

Bicycles on the sidewalk have the rights and duties of a pedestrian, therefore...

  • 316.130(7)    When traffic control signals are not in place or in operation, the driver of a vehicle shall yield right-of-way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger.

  • 316.130(8)    No pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close that it is impossible for the driver to yield.

  • 316.130(10)    Every pedestrian crossing a roadway at a point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles upon the roadway.

  • 316.2065(11)    A person propelling a bicycle upon and along a sidewalk, or across the roadway upon and along a crosswalk, shall yield the right-of-way to any pedestrian and shall give an audible signal before overtaking and passing such pedestrian.

  • USE HAND SIGNALS

  • MAKE EYE CONTACT WITH MOTORISTS, BE COURTEOUS TO MOTORISTS

  • OBEY TRAFFIC LAWS, BE PREDICTABLE.
